Veterans Benefits Law states that veterans and certain members of their families are entitled to government benefits such as long-term care, disability benefits, pensions, home loan guarantees, life insurance and burials. The array of benefits and qualifying for them can be confusing and difficult to navigate. We assist veterans in applying for programs and services. Veterans have options for managing illnesses requiring long-term care and getting help with daily tasks. Such needs are met through both home- based and community-based services. We guide veterans through the maze of options. Like all of us, veterans should have estate plans not only to address healthcare needs, but also financial and legal matters and documents to preserve assets and pass them on to loved ones.
Veterans Aid and Assistance
Our veteran benefits attorneys help disabled service members get the long-term care benefits they deserve. Separate from other veteran benefits, the Veterans Aid and Assistance program helps veterans and their spouses pay expenses related to nursing home, assisted living or home health care. The available benefits range from $1,632 to $2,540 a month for a married couple if both spouses are veterans.
A veteran and his or her spouse are eligible for such assistance if they need help with the activities of daily living. For those over age 65, the need does not have to be a result of military service. For those under 65, assistance is available if there is a total disability or a service-related partial disability.
VA Benefit Eligibility
There is also an asset limit. The asset-related rules for obtaining VA benefits are very different from Medicaid eligibility rules, which veterans may also need at some point. . A servicemember can obtain VA benefits and still remaining eligible for Medicaid benefits. Our veteran benefit attorneys are knowledgeable in the requirements for and applications to both programs.
